11/20/96 14:00 Collect CCC-Ravi Mani 1 RAY 9

Class was in Macintosh and graphics software via Ravi Mani company to TRW which has many defense related contracts.

The night before the class, Ravi Mani, president of CCC calls Computer Instructors Corporation (CIC) president Rick Shaddock to ask if he can teach a 3 day class for TRW.   Even though Ravi and Rick were competitors, Simon had other billable assignments, and against the advice of Frank of CIC, Rick agrees to do the Christian thing and help thy neighbor.  Rick was busy but told Ravi he would send one of his instructors, Simon Nay, a Macintosh and graphics expert.

TRW liked Simon much better than the instructors Ravi had been sending.
TRW complained to Simon about the lack of organization CCC exhibited.
CCC did not provide good course booklets if at all.
Supervisor said they were planning to discontinue using CCC.
Simon said he was not with CCC, but CIC.  They gave Simon a business card.

It was a 3 day class.  If there were any problems, or disatisfaction they would have called, and requested a different instructor after the first day.  No problems were reported, and the evaluations from the students were excellent.  Nevertheless Ravi maintains that the class "lost him the contract" and that the fee is "not owed."  Even if the class did not go well, he still contracted for 3 days of instructor work from CIC.

It is possible that Ravi, knowing for weeks that his contract had not been going well, and was about to be terminated, decided to hire someone he would not pay, so that his instructors could teach elsewhere.

Ravi did not pay 3 x $250 = $750
Lost of cost of Simon's fee: $375
Lost profit potential: $750 - $375 = $375

Account turned over to Ray Arbaugh for collection work - he went over with Warrant in Deed

Sharon, in charge of CIC Marketing, began making calls to TRW, and followed up with Gerry Stock TRW's Director of Training - and obtained training contract worth over $70,000
CIC could consider the $375 loss to Ravi Mani to be his "finder's fee" but after his refusal to acknowledge the class went well, CIC has decided to consider it a debt owed.
